MK500,000 penalty for vandalising ESCOM equipment

The First Grade Magistrate’s (FGM) Court in Ntcheu has on February 21,2022 convicted and sentenced 28 year-old Frank Windilosi to pay a fine of K500,000, or in default to serve 48 months imprisonment with hard labour (IHL) for stealing and vandalising the Electricity Supply Corporation of Malawi (ESCOM) electric cables.

The Court heard through the State prosecutor Sub Inspector Brazio Kambalame that Police received a report that unknown criminals had vandalised and stolen 1200 metres oak wire of ESCOM main line at Chiole water source site.

Immediately, Police launched investigations leading to the arrest of the suspect, who was caught selling the cables. The bags containing the stolen wires were recovered at the suspect’s house.

Windilosi later demonstrated at the site how he tampered with the electric wires.

When appearing in court, Windilosi pleaded guilty to the counts of theft and vandalism levelled against him.

In his submission, Sub Inspector Kambalame prayed for a harsh sentence arguing that vandalism is a serious offence hence a deterrent has to be set for would-be offenders.

In mitigation, Windilosi said he is a bread winner for his family and that he looks after old parents.

In his ruling, FGM Chimdima Phiri concured with the state and ordered Windilosi to pay a fine of MK400,000 on the first count of vandalizing electrical installation equipment and MK 100, 000 on the second count of theft.

The offences are contrary to sections 45 (2) (d) of the Electrical Act and 278 of the Penal code respectively.

However, in default Windilosi has to serve 48 months IHL. He has not paid the fine yet.
