Mangochi Senior Resident Magistrate’s Court on January 13, 2022 convicted and sentenced Daudi Mustafa, 34, to 14-years imprisonment with hard labour for robbing an lndian businessman a sum of 3 million Kwacha contrary to section 301 of the Penal Code.
The court through State Prosecutor, lnspector Amos Mwase heard that, Mustafa was previously convicted of a similar offence.
On the night of May 29, 2021, the convict and his four accomplices broke into Sheikh Muhammad Sajid’s house after beating and tied the security guard with ropes.
Prosecutor Mwase added that the convict and team who were armed with machetes ransacked the victim’s house and demanded cash and jewelries while threatened to harm the whole family.
The victim surrendered the 3 million cash he kept in the house and assorted jewelries and the criminals fled the scene.
The matter was reported at Mangochi Police Station and investigations were Instituted which led to the arrest of Mustafa and one of the accomplice.
Appearing in court, the convict pleaded not guilty to the charge and the state paraded five witnesses who proved the case beyond reasonable doubt.
In mitigation, the convict asked for leniency citing that he is disabled and provides for his family who will suffer if sent to prison but Prosecutor Mwase told the same court that the lives of the victims were in danger and believed that they were spared due to their cooperation hence prayed for stiffer sentence.
Passing judgement, Senior Resident Magistrate Rodrick Michongwe concurred with the state and sentenced him to 14-years imprisonment hard labour to act as a deterrent to other would be offenders.
Daudi Mustafa hails from Ngongondo Village, Traditional Authority Liwonde in Machinga.
