In his cross examination by another of Mpinganjira’s lawyers, Fostino Mayere, Justice Kapindu has conceded that he was not part of the conversations between Mpinganjira and Justice Tembo and between Mpinganjira and Justice Potani.

He however says he listened to the conversation between Justice Tembo and Mpinganjira to vouch for the truthfulness of the conversation.

Justice Kapindu concurs with Justice Michael Tembo that they did not report the matter to the Anti Corruption Bureau (ACB) immediately because doing so would have compromised their concentration on the case.

The matter has been adjourned to Friday where Justice Ivy Kamanga will give her testimony.

The defense through Lawyer Fostino Mayere  has started cross examining the witness.

Mayere: Dr Kapindu have you ever interacted with Mpinganjira?

Kapindu: No.

Mayere: You said you listened to the conversations, how many were speaking?

Kapindu: Two

Mayere: Who are they?

Kapindu: Justice Tembo and the accused.

Mayere: How do u know it was the accused?

Kapindu: I have heard him so many times in media platforms.

Mayere: Which media platform MBC , Zodiak and Times TV.

Mayere: What was he saying?

Kapindu: l can’t recall , l had no interest.

Mayere:How do you know that it was the accused when you had no interest in the conversation.

Mayere: But you said you had no interest?

Kapindu: l Know his voice because l have listened to him in so many media platforms.

Mayere: Can you confirm you were not part of the conversation between Mpinganjira and Tembo?

Kapindu: l confirm.

Mayere: Was the corruption complaint lodged by the Chief Justice?

Kapindu: l confirm yes and  it was in December 2019.

Mayere: lt was over a month after the matter came out?

Kapindu: Yes

Mayere: Are you aware that it is an offence not to report a suspected case within 48hrs?

Kapindu: Yes with exceptions.

Mayere: What exceptions?

Kapindu: We never wanted to be distrupted in hearing the presidential election case.

Mayere: How many minutes would it have taken to report the matter?

Kapindu: A few minutes.

Mayere: One of the parties was attempting to bribe the judges, was it ethically right to proceed hearing the presidential election case?

Kapindu: Dr Mpinganjira was not party the case.

Judge Redson Kapindu has finished testifying. The court has since adjourned to Friday, November 27, 2020, when Judge Ivy Kamanga and ACB investigators are expected to give their testimonies.
