The Senior Resident Magistrate’s (SRM) court in Ntcheu has on February 22, 2022 convicted and sentenced 39-year-old Fyson Noah to 20 years imprisonment with hard labour (IHL) for defiling a 13-year-old girl contrary to section 138 of the Penal code.
The court heard through Police Prosecutor Sergeant Happiness Gandali that during the night of October 11, 2021 at Matsimbe Village, Noah induced the victim with money amounting to K600. He took the victim to his house and defiled her twice.
Upon noticing the absence of the victim, her parents started searching and later found her at the convict’s house.
However at Police, the victim was referred to Ntcheu District Hospital for examination and treatment. The medical result indicated that the victim was indeed defiled, leading to the arrest of the suspect.
In court, the accused was convicted based on his own plea of guilty.
In submission, Sergeant Gandali pleaded with the court for a stiffer punishment citing that the offence committed is serious in nature, hence the need to deter others with similar intention.
In mitigation, Noah asked the court for leniency arguing that he looks after his family.
Passing sentence, SRM Joshua Nkhono concured with the state and slapped the convict with 20 years IHL.
