CHINA CASE ON STATE VS ACCUSED B.JERE

Criminal Case 787 of 2020 involving the State vs the accused B. Jere (pleaded not guilty) before Principal Magistrate His Worship Chiotcha has been temporarily withdrawn based on Section 81 (a). Of the Penal Code.
The victim Inspector Chirwa – main witness, testified that he was indeed beaten on his right cheek by the accused on 26/10/2020 around 7pm at Chamonomo Ezondweni where Police mounted a road block.
The victim was being blamed by the Chief for stopping the 2 business persons (Innocent & Mr Hara) to continue on building their shops in the area. The victim responded by saying the matter was in the Chief’s office. The Chief alighted from his car and the victim as a Police officer helped him to open the door. The Chief was furious with the officer helping opening the door and later shouted at him by saying, “Wakhwafyirachi nga galimoto njako.?” (Why touching my car as if it is yours?). Then the Chief punched a blow and landed on the right cheek of the officer. He wanted to retaliate but he was cooled down by others.

The officer now, informed the court of his intention to withdraw the case because the Chief is like his father. He’s also a Ngoni from Mzimba Mzikubola T/A. He added that he is a God fearing officer hence has already forgiven the Chief.
The officer appealed to the accused through the court that the Chief must change his behavior of ill treating the civil servants in his area. What he did was unacceptable and unheard of as such he must stop and change for the better. He must be treating his subjects well with dignity.

The State obliged to the victim’s request so as the defense team.

The court has therefore discharged him but informed him that the State has the liberty to resuscitate the case within 12 months if something crops up.
