Man slapped 7-years IHL for breaking offences

The Lilongwe First Grade Magistrate’s Court has convicted and sentenced a 48-year-old man, Gibson Chowe to spend 84 months in jail for breaking into a building and commiting a felony there in, contradicting section 311(a) of the Penal Code.

The court heard through state prosecutor Sub Inspector James Luwani from Kawale Police Station that in March this year, the convict and other three accomplices broke into a shop of Mrs Ella Mvela during the night time, in Area 38 and went away with 300 wrappers and 15 plastic basins a thing that was discovered by the owner in the morning after the incident .

Later, the case was reported at Area 24 Police Unit where detectives under the formation investigated the case and swiftly arrested the 4 suspected criminals.

Appearing in Court, the other three pleaded guilty and were earlier on ordered to spend in jail for 84 months while Gibson Chowe pleaded not guilty. This prompted the state to parade three witnesses who testified against him

In his submission, Sub Inspector James Luwani Prayed for a stiff custodial sentence citing that this was an organized case, a threat to ones right to economic development which is becoming fashionable in the area.

In his mitigation Gibson Chowe begged for leniency citing that he takes care af a family and an elderly mother.

Passing Judgement his worship Charles Phiri quashed him and sentenced him to 7 years imprisonment with hard labor.

Gibson hails from Chimwaye Village Traditional Authority Mazengera in Lilongwe District.
