Mangochi First Grade Magistrate Court on Friday March 12, 2021, convicted and sentenced Sinoya Daimon 22, to 30 months Imprisonment with hard labour (IHL) for causing death by reckless riding.
The Court heard from Eastern Region Prosecution lnspector (RPI), Assistant Superintendent Peter Piringu, that on February 2, 2021, the convict rode unregistered and uninsured motorcycle from the direction of Namwera heading to the main roundabout, carrying two pillion passengers.
Upon arrival at Pep Store due to overspeeding, Daimon who has no motorcycle licence hit a 62-year old male pedestrian who was crossing from left to the right hand side of the road.
Prosecutor Piringu added that, following the impact, the victim sustained head injuries and died upon arrival at Mangochi district hospital.
Appearing in court, the convict pleaded guilty to the charges which were levelled against him.
In mitigation Daimon asked for court’s leniency stating that he is a breadwinner for his family. However, the state objected his mitigation factors arguing that his behavior terminated an innocent person’s life.
Passing sentence, First Grade Magistrate Roy Kakutu concurred with the state and sentenced him to 30 months IHL for the account of causing death by reckless riding and 8 months IHL for riding uninsured motorcycle and without rider’s licence.
The convict was not given an option of a fine and the sentences will run concurrently.
Sinoya Daimon hails from Katema village Traditional Authority Mponda in Mangochi.
