The High Court in Lilongwe has lifted an injunction obtained by some concerned refugees, restraining government through the Ministry of Homeland Security from implementing the repatriation of all refugees back to Dzaleka Refugees Camp.
In a court ruling dated May 21 2021, issued by the High Court Judge, Justice Ruth Chinangwa, the Judge had observed that the injunction against the government move was erroneously issued as the injunction was issued by an Assistant Registrar of the Court and not the judge herself.
According to Judge Chinangwa, this was an error at law, as the court had no knowledge about it.
However, the court has granted a judicial review to the refugees on the matter.
The injunction means that government can proceed to repatriate the refugees to Dzaleka.
