The case of Tumpe Mtaya, popularly known as Phwedo, is currently before the Lilongwe Chief Resident Magistrate’s Court, with Magistrate Benjamin Chulu presiding.
Phwedo faces two serious charges: engaging in sexual intercourse with a minor and child abduction, after allegedly taking the child without parental consent.
However, the court session stalled before reaching the plea stage. The defence team—comprising Counsel Khwima Mchizi, Stanley Chirwa, and Robert Kadzakumanja—raised objections, citing that the State had not yet provided them with the charge sheet or key disclosures necessary for the proceedings.

In response, the State clarified that the hearing was not meant for plea taking but to inform the accused of the reasons for his detention. The prosecution also noted that investigations are ongoing and requested an additional five days to conclude them.
The State further opposed bail, expressing concern that Phwedo, who is familiar with the witnesses, might interfere with them if released.
The court will issue further directions as the case continues to unfold.
