Man gets 18-years IHL for defiling minor
The Mangochi Senior Resident Magistrate Court on Wednesday July 21, 2021 convicted and sentenced King Afia, 36, to 18 years Imprisonment with Hard Labour (IHL) for defiling a 10-year old girl contrary to section 138(1) of the Penal Code.
During court proceedings, Namwera Police Prosecutor Sub Inspector Blessings Madikhula told the court that, on January 23, 2021 a mother to the victim noted that her daughter was having difficulties when walking.
She quizzed the victim who revealed to have been defiled three times by accused person.
Prosecutor Madikhula added that, the victim also confessed that Afia was using vaseline to lubricate her private part before penetrating.
The matter was reported at Namwera Police Post where medical report form was issued and the results from Namwera Health Centre confirmed that the girl was defiled.
Appearing in court, the accused person pleaded not guilty to the charge and the state paraded four witnesses who proved the case beyond all reasonable doubt.
In mitigation, he asked for the court’s leniency saying that he is a breadwinner to his family but the state quashed his plea, arguing such cases are on the increase despite government and stakeholders relentlessly working towards protecting and uplifting rights of the girl child.
When passing sentence, Senior Resident Magistrate Rodrick Michongwe concurred with the state and hence the sentence to serve as a lesson to him and other would-be offenders.
King Afia hails from Kandulu village, Traditional Authority Jalasi in Mangochi.
