HIGH COURT FIRES DPP SPONSORED MEC COMMISSIONERS

High Court Judge Kenyatta Nyirenda has quashed the appointment of Democratic Progressive Party (DPP) MEC commissioners saying former president Peter Mutharika errored in law.

The ruling comes after the Malawi Congress Party (MCP) sued president on the appointment of the commissioners.

According to the learned judge, the law allowed Mutharika to appoint 3 commissioners from DPP and 3 from MCP, but the president appointed 4 from DPP and 2 from MCP.

Nyirenda has since ordered DPP to submit three names within seven days who will fill up the gap. The ruling has also highlighted that the two MCP commissioners will continue to serve in the commission.

The four DPP-MEC Commissioners that have been shown an exit door are Linda Kunje, Jean Mathanga, Arthur Nanthuru and Steve Duwa.

While two MCP commissioners who have remained in the commission are Anthony Mukumbwa and Olivia Liwewe.

In 2014 Judge Kenyatta Nyirenda made a ruling around midnight which forced MEC to declare Peter Mutharika of DPP as the president elect and the following morning he was sworn in as the as the 5th president of the republic of Malawi.
