The Lilongwe Magistrate Court on Wednesday, May 12 ,2021 convicted and sentenced a 20 – year -old young man , Nenani Frackson to 10 years imprisonment with hard labour for defiling a 13 -year -old girl (name withheld) in area 24 location.
The court through the state prosecutor , Sergeant Winnie Phiri of Kawale Police on May 12,2021 heard that in the month of April, 2020 the convict defiled a 13 -year -old girl who was a standard six leaner at Lunzi primary school.
The convict enticed the young girl and defiled her in one of the un finished building within area 24.
After some months the school discovered that the girl was pregnant,parents were informed who reported the matter to Kawale Police .
Defilement case was opened against him which is contrary to section 138 ( 1) of penal code.
In court, Frackson denied the charge such that the state had to parade four witnesses whose evidence proved the matter beyond reasonable doubt.
In submission , prosecutor Phiri asked the court to hand the convict a deterrent sentence, citing that the future of the girl has been ruined .
In mitigation,the convict prayed for leniency saying that he is still young and to spend in prison many years will doom his future .
The Senior Resident Magistrate, Montfort Misunje concurred with the state and eventually ordered Frackson to spend 10 years in jail .
Frackson hails from Salijeni village , Traditional Authority (T/A) Nsabwe in Thyolo District.
